Adageo Terms of Service

1. About Adageo

Adageo is a social music discovery platform operated by SIM SAS ("we," "us," "our"). The app lets you:

• Share songs with your location on a world map
• Discover music from people around the world
• Follow music lovers and make friends
• Chat with other users
• Find hidden "treasure chest" music discoveries
• Build a collection of discovered songs

2. Eligibility

Age Requirement: You must be at least 13 years old. If under 18, you need parental/guardian permission.

By using Adageo, you confirm that:

• You meet the age requirements
• You have legal capacity to agree to these Terms
• You're not prohibited from using the service by law
• All information you provide is accurate

3. Your Account

3.1. Creating an Account

To use Adageo, you must create an account. You agree to:

• Provide accurate information (email, username)
• Keep your password secure and confidential
• Not share your account with others
• Not create fake or multiple accounts to abuse features
• Notify us immediately if your account is compromised

3.2. Account Responsibility

You're responsible for all activity under your account. We're not liable for unauthorized access due to your negligence.

4. Acceptable Use

4.1. Prohibited Content

You agree NOT to post, upload, or share:

• Illegal Content: Promotes crime, violence, terrorism
• Hate Speech: Harassment, bullying, discrimination based on race, religion, gender, sexuality, disability, etc.
• Sexual Content: Nudity, pornography, sexual solicitation
• Harmful to Minors: Exploitation, sexualization of children
• Violence: Graphic violence, gore, self-harm
• Misleading: False information, impersonation, scams
• Copyright Violations: Unauthorized use of others' content
• Spam: Repetitive, unsolicited, promotional content
• Malware: Viruses, harmful code

4.2. Prohibited Behavior

You agree NOT to:

• Harass, threaten, or stalk users
• Impersonate others
• Use bots, scrapers, or automated tools
• Hack or interfere with the app
• Reverse engineer the app
• Sell or transfer your account
• Collect users' data without permission
• Use Adageo for commercial purposes without authorization

5. Your Content

5.1. Ownership

You retain ownership of content you create: posts, photos, captions, messages, profile.

5.2. License to Adageo

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Display your content in the app
• Store it on our servers
• Process it to provide features (e.g., resize images, show on map)
• Share it with other users as you direct

This license ends when you delete content or your account (except content shared with others, like messages).

5.3. Content Responsibility

You're solely responsible for your content. We don't endorse or verify user content. You agree to defend and hold us harmless from any claims arising from your content.

6. Music and Copyright

6.1. Apple Music Integration

Adageo uses Apple Music API for song search and previews. You also agree to comply with Apple's Terms of Service.

• Previews limited to 30 seconds
• Previews provided by Apple, subject to availability
• You cannot download, record, or redistribute preview audio
• Album artwork and metadata are copyrighted by rights holders

6.2. Copyright Infringement

If you believe content infringes your copyright, email soporte@adageo.app with:

• Description of copyrighted work
• Location of infringing content (post ID/URL)
• Your contact information
• Statement of good faith belief
• Statement under penalty of perjury that info is accurate

7. Moderation and Enforcement

7.1. Content Moderation

We reserve the right (but not obligation) to:

• Review and moderate user content
• Remove content violating these Terms
• Suspend or terminate accounts for violations
• Report illegal activity to authorities

7.2. Reporting

Report violations using the in-app report button or email soporte@adageo.app.

7.3. Blocking

You can block users to prevent them from messaging you or viewing your content.

7.4. Consequences

• Warning: First-time minor violations
• Content Removal: Violating posts/messages deleted
• Temporary Suspension: Account access temporarily revoked
• Permanent Ban: Account and all content permanently deleted
• Legal Action: For serious violations

8. Treasure Chests

Adageo includes "treasure chests" - special hidden posts on the map:

• Created by Adageo administrators only
• Discovered by zooming in close on the map
• Each chest discoverable once per user
• Different rarity levels (Normal, Rare, Secret)
• Discoveries appear in your profile collection

We reserve the right to modify or remove the chest system anytime without notice.

9. Privacy

Your use of Adageo is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

By using Adageo, you consent to:

• Location collection when you use the app
• Photo access for images you choose to share
• Public display of posts and profile
• Storage of messages and content on our servers

10. Third-Party Services

Adageo integrates with third-party services (Apple Music, cloud hosting). These have their own terms and privacy policies. We're not responsible for third-party practices.

11. Disclaimers

11.2. No Guarantees

We don't guarantee that:

• Adageo will be uninterrupted, secure, or error-free
• Content will be accurate or up-to-date
• Defects will be corrected
• The service will meet your needs

11.3. User Content Disclaimer

We're not responsible for user-generated content. Users, not Adageo, are responsible for what they post.

12. Limitation of Liability

To the maximum extent permitted by law, SIM SAS will NOT be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or use
• Service interruptions or errors
• User content or conduct
• Third-party services

Our total liability for any claim won't exceed $100 USD or the amount you paid us in the past 12 months (whichever is greater).

13. Indemnification

You agree to indemnify, defend, and hold harmless SIM SAS from any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of Adageo
• Your content
• Your violation of these Terms
• Your violation of third-party rights
• Your violation of laws

14. Changes to Service

We reserve the right to:

• Modify, suspend, or discontinue features
• Change pricing (if we introduce paid features)
• Update the app
• Impose usage limits

We'll try to provide reasonable notice of significant changes but aren't obligated to.

15. Termination

15.1. By You

Delete your account anytime: Profile → Settings → Delete Account. Deletion is permanent and cannot be undone.

15.2. By Us

We may suspend or terminate your account anytime, with or without notice, for:

• Violation of these Terms
• Violation of laws
• Fraudulent, abusive, or harmful behavior
• Extended inactivity
• Any reason at our discretion

15.3. Effect of Termination

Upon termination, your account, posts, messages, and discoveries are deleted. Certain provisions survive (indemnification, disclaimers, limitation of liability).

16. Dispute Resolution

16.1. Governing Law

These Terms are governed by the laws of Colombia.

16.2. Disputes

Disputes will be resolved through:

1. Informal Resolution: Contact soporte@adageo.app first
2. Arbitration: Binding arbitration in Colombia if informal resolution fails

16.3. Class Action Waiver

Disputes resolved individually only, not as class actions.

17. Changes to Terms

We may update these Terms. When we do:

• We'll update the "Last Updated" date
• We'll notify you via app or email for significant changes
• Continued use after changes = acceptance

If you don't agree with changes, stop using Adageo and delete your account.

18. General

18.1. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and SIM SAS.

18.2. Severability

If any provision is unenforceable, the rest remain in effect.

18.3. No Waiver

Our failure to enforce doesn't waive our right to enforce later.

18.4. Assignment

You can't transfer your rights. We can assign ours to any third party.

18.5. Language

English version controls in case of translation conflicts.
